Terms and Conditions for Friends of Royal Lyver website

PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY. BY DOING SO, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS DESCRIBED HEREIN.

This Agreement governs the terms by which visitors and members Friends of Royal Lyver (in these conditions referred to as ‘FORL’) host media content provided by members of the friendsofroyallyver.co.uk community through the web site located at www.friendsofroyallyver.co.uk  (the ‘Site’). Terms of Use applicable to the Site and to the Membership that all persons providing content to or downloading content from the Site have sole responsibility for that content and have agreed to these conditions by visiting the Site.

 

1. COPYWRITE

(a) The property in any goods and/or work published on the Site commissioned and paid for by FORL remains the sole property of FORL and ownership will not pass over unless specified in written confirmation by authorized persons acting on behalf of FORL.

(b) The Site and by association FORL do not accept responsibility for publishing or seeking to obtain copywrite for content supplied to FORL and also including content already in the public domain and accessed or read via any part of the Site.

(c) FORL reserve the right edit, amend or adjust any content freely provided for inclusion on the Site. Member and users of the Site accept these terms and will make their own provision for backing up original digital files.

 

 

2. PERMITTED STANDARD USES

(a) You may only use the content hosted on the Site for editorial use. Only limited to personal or non-commercial uses. For clarity, you may not use the content in for resale, license or merchandise without seeking the specific permission of the owner of the property (1b).

 

3. MATERIALS SUPPLIED TO FORL

(a) Property supplied to FORL shall be held at the owners own risk while FORL shall take reasonable care thereof.

(b) FORL shall be entitled to make a reasonable charge for storage of any Client’s property left with them. It shall be the responsibility of the owner to collect the property from FORL.

(c) FORL may reject any paper, plates or other materials supplied or specified by the Client which appear to them to be unsuitable. Additional costs may be incurred where materials are found to be unsuitable and in need of alteration before upload and archive on the Site.

(d) Where materials are so supplied or specified FORL will use their best endeavours to secure the best results but responsibility will not be accepted for imperfect work caused by defects in or unsuitability of materials supplied or specified.

 

 

4. ILLEGAL MATTER

(a) FORL shall not be required to publish any matter which in their opinion is or may be of an illegal or libellous nature or an infringement of the proprietary or other rights of any third party.

(b) FORL shall be indemnified in respect of any claims, cost and expenses arising out of any libellous matter or any infringement of copyright, patent, design or of any other proprietary or personal rights contained in any material printed for the Client. The indemnity shall extend to any amounts paid on a lawyer’s advice in settlement of any claim.

(c) The views and accounts represented within content published on the Site and also by comments posted by visitors to the Site are not the views of FORL and do not represent FORL only that of the author.

 

5. LAW

These conditions and all other express terms of the Contract shall be governed and construed in accordance with the Law of England.
